General Information

The Ministry of Justice was created in 1956 during the joint Somali/Italian administration with the aim of achieving a sustainable democratic system of governance that operates within a clearly defined and predictable legal environment. The responsibility of the Ministry is to promote democracy, good governance and human rights through the development of policies and programs that enhance the enjoyment of social, economic and political rights. The Ministry of Justice is headed by a Minister who is appointed by the Prime Minister and supported by the deputy Minister. The duties and obligations include: policy formulations on legal drafting, advocacy, external relations, as well as to serve as agents for justice, and respect to the supremacy and rule of law. The Ministry is administered by the Director-General (DG) and the rest of the departments working under him as the structure indicates.

Background Information about Host Institution

The Ministry of Justice is a public federal government institution. Its mission is to;

  • To continually strive to empower our people by delivering justice, equality before the law, truth, dignity and integrity;
  • To assist in restoring order and to create faith in an environment where the rule of law prevails;
  • To promote democracy, good governance and human rights through the development of policies that enhance the enjoyment of social, economic and political rights;
  • Building and strengthening the capacity of the justice system especially the independence of the Judiciary, based on Justice, Equality, Trust and respecting the Constitution, Laws and other By-laws of the Country.

POSITION INFORMATION

This position falls within the framework of the Federal Government of Somalia Ministry of Justice (MOJ) and its endeavours to coordinate and be a focal point of the ministry’s relations with the office of the Prime Minister (OPM) regarding the implementation of the Government’s Justice and Security Roadmap and in line with NDP9. MOJ seeks a Legal Advisor to provide technical support to the MOJ’s legal affairs department in coordinating the development and implementation the ministry’s role of the Justice and Security Roadmap on legal drafting and legal reform activities.

Objectives of Assignment

The Legal Affairs Advisor will report to the Director of Legal Affairs Department as immediate supervisor, and also Director-General (DG) of the ministry and is responsible to coordinate and fulfil legal roles and external interactions in favour of the JSRP/NDP9. The incumbent will conduct services with, make submissions to and build relationships between OPM’s office JSR/NDP9, The MoJ, and other similar legal divisions and legal authorities of government ministries and institutions that are part of “Justice and Security Roadmap” (JSR) which is the major stumbling block for the ministry to undertake and deliver on these pivotal tasks.

Output/Deliverables

Ministry’s role on “Justice and Security Roadmap” national Agenda is delivered.

Responsibilities and Accountabilities

  • Provide overall technical advice support on the coordinating the development and implementation the ministry’s role of the government’s roadmap on “Justice and Security Roadmap” program activities, and guidance to departments within the MOJ as needed, and attend briefings and planning meetings;
  • In cooperation with the Director of Legal Affairs Department, develop a consultation plan, guiding the MOJ in conducting stakeholder consultations with Federal Justice sector agencies and FMS Justice institutions on the implementation of activities of the Roadmap;
  • In cooperation with the Director of Legal Affairs Department, organize and facilitate stakeholder consultations for the Roadmap, submitting activity reports detailing discussions and next steps;
  • Analyses the situation, advises and provides guidance on the applicable domestic, as well as international legal frameworks and norms, in relation to the delegation activities, objectives, strategies and plans of action to address identified legal and other related issues;
  • Transfer his/her knowledge and skills to the Legal Affairs Department local staff.
  • Perform other work-related duties as required.

Education and Experience

  • A degree in Law or related field
  • At least 3 years of professional experience in legal reform and any legal practices
  • Experience in Somalia or in similar contexts is highly desirable;
  • Sound understanding of Somali legal development needs and justice/judiciary environment;
  • Strong communication and interpersonal skills, and the ability to develop excellent relations with Somali counterparts and donor officials;
  • Ability to live, work, and travel in Somalia.

Ability to write, read and communicate in Somali and English
